I’m not sure Spitzer isn’t chasing them himself here. There is a huge group of people in the middle on the gay marriage issue who aren’t strongly opposed to gay unions, but who don’t want to see the law openly flouted. Spitzer is wisely playing to them as well as actually doing his job.

It’s as smart politically as it is necessary legally.
