Now, I know we all tend to be a bit colloquial when writing on the web, but this is a US Senator writing – or, more likely, dictating or having written by a staffer – about a man who’s been on the federal bench for 15 years. I’m put in mind of this exchange:

Col. Jessep: I’d appreciate it if he would address me as “Colonel” or “Sir”… I believe I’ve earned it.
Judge Randolph: Counsel will refer to the witness as “Colonel” or “Sir.”
Col. Jessep: I don’t know what the hell kind of unit you’re running here.
Judge Randolph: And you will refer to this court as “Your Honor” or “Judge”… and I’m quite certain I’ve earned it.

    I thought we lived in a country where the prerogatives of power are limited. Unless you’re prepared to refer to him as “Senator Kennedy” in your piece, why should Ted or Kos or anyone refer to Sam as “Judge Alito”?

  3. Yes, they’re all quite certain that they’ve earned it. They’re not all so certain about the rules of evidence, unfortunately.

  7. Wow…the venom and bile of a site like Kos is stunning, the ad hominen attacks incessant. Some of these people honestly believe that the “fate of the Republic is at stake” if a unanimously-confirmed Appellate Court judge is confirmed on the Supreme Court.
    What has happened to the once-great Democratic party? All the sane voices are being drowned out by those who would so short-sightedly cry wolf whenever the mood should strike. And Senator Kennedy plays right to them, while Senator Byrd is suddenly a pariah.
    Judge Alito’s confirmation may indeed harm the Republic–not because of his rulings, but because of his compentence. It may be the event by which a once-great party completely lost touch with the citizenry, and slid into total irrelevance. And we will all be worse for having lost a reasonable dissenting voice.

    They’ve gone nuts as far as I can tell. Loco, nutso, barking at the moon raving at ghosts insane. It isn’t just Kennedy either. Kerry is posting over at Kos, and Boxer has been for some time.
    Kos isn’t just left, it is ragged edge Dick Cheney’s space alien friends are watching me eat my breakfast extremely hard looney left. I have no idea what they think they’re doing associating themselves with that bunch. Does Kerry still consider himself a viable presidential candidate? Just imagine how his next opponent will be able to use this association against him in the next campaign, all the foul anti-US nonsense that will be posted on Kos over the next 3 years.

  10. Crank – since you usually provide great insight into the nitty/gritty of legal proceedings, I’d be interested in your take on GWB’s maneauvers to replace the man in charge of the Abramoff investigation.
    As quoted in Howard Kurtz’s column this morning (originally reported by Martin Garbus):
    “At some point, it all becomes unbelievable.
    “President George W. Bush has not made many moves more unethical than offering Noel L. Hillman, the Abramoff prosecutor, a federal judgeship. Hillman has apparently been talking with Bush’s representatives since last year, and on last Thursday, he publicly announced he was accepting the appointment.
    “Let me make this perfectly clear. At the same time that Mr. Hillman was conducting a grand jury and submitting evidence aimed at Bush’s allies and perhaps Bush himself, he was meeting with Bush, who was, in effect, offering him a bribe.
    “Mr. Hillman, Bush is saying, leave the job, let me put someone else in your stead, someone I want. Forget, says Mr. Bush, that you have been in charge of the investigation for two years, that you have been involved on a day-to-day basis, and that your leaving seriously impedes the investigation.”
