Darren Kaplan notes that Solicitor General Ted Olson will personally argue the government’s case before the Supreme Court in Rumsfeld v. Padilla, the case addressing the government’s ability to detain “dirty bomb” suspect Jose Padilla. As you may remember, Olson’s wife was killed on September 11.

I admire Olson and personally wish him well, but he�s on the wrong side of this case, in my view.
As I�ve written here a few times, the government should not be able to indefinitely detain U.S. citizens without regard to the Bill of Rights, even during times of war. This is much different than the guys at Guantanamo. Padilla certainly shouldn�t be released, but should be remanded to the criminal justice system to face prosecution.
In internal discussions, didn’t Olson argue against keeping Padilla in lockdown?
I have absolutely no admiration for Ted Olson as SG or in his previous incarnations. I wish him well in the personal struggles he surely endures from losing his wife, but not on this case. I’m with the Hibernian, the gov’t is clearly wrong in Padilla’s case, but I would add that the Gitmo case is debatable as well.
